1. ACCEPTANCE OF TERMS

By booking a charter trip with Mayan Reel Adventures (“Company,” “we,” “us,” or “our”), you (“Client,” “Guest,” or “you”) agree to be bound by these Terms and Conditions. These terms apply to all services provided by Mayan Reel Adventures, including but not limited to fishing charters, equipment rental, and guide services.

2. BOOKING AND PAYMENT

2.1 Reservation Requirements

  • All bookings must be confirmed with a deposit of 50% of the total charter fee
  • Full payment is required 48 hours prior to departure
  • Bookings are not confirmed until deposit is received
  • We accept cash, credit cards, and bank transfers

2.2 Pricing

  • All prices are quoted in [Currency] and are subject to change without notice
  • Prices include captain, guide services, fishing equipment, bait, and ice
  • Fuel surcharges may apply and will be communicated at time of booking
  • Gratuities are not included and are at the discretion of the guest

3. CANCELLATION AND REFUND POLICY

3.1 Client Cancellations

  • More than 7 days: Full refund minus 10% processing fee
  • 3-7 days: 50% refund
  • Less than 48 hours: No refund
  • Same day/No show: No refund

3.2 Weather Cancellations

  • Trips may be cancelled due to unsafe weather conditions as determined by the Captain
  • Weather cancellations result in full refund or rescheduling at no additional cost
  • Minor weather conditions (light rain, overcast skies) do not constitute grounds for cancellation

3.3 Company Cancellations

  • If we must cancel for reasons other than weather, full refund will be provided
  • We will attempt to reschedule at your convenience
  • Company is not responsible for consequential damages or expenses

4. SAFETY REQUIREMENTS AND RESPONSIBILITIES

4.1 Guest Responsibilities

  • All guests must be able to swim or wear provided life jackets
  • Guests must follow all safety instructions given by the Captain and crew
  • Consumption of alcohol is permitted but excessive intoxication may result in trip termination
  • Illegal drug use is strictly prohibited
  • Guests must disclose any medical conditions that may affect their ability to participate

4.2 Age Requirements

  • Children under 12 must be accompanied by an adult
  • Children under 6 require special accommodation and advance notice
  • All minors must have signed parental consent forms

4.3 Equipment and Vessel Safety

  • All safety equipment is provided and must be used as directed
  • Guests are responsible for any damage to equipment due to negligence
  • The Captain has final authority on all safety matters

5. WHAT’S INCLUDED AND EXCLUDED

5.1 Included Services

  • Professional fishing guide/captain
  • Fishing rods, reels, and tackle
  • Bait and ice
  • Fish cleaning and bagging
  • Safety equipment
  • Bottled water

5.2 Not Included

  • Food and beverages (except water)
  • Fishing licenses (guest responsibility)
  • Gratuities
  • Transportation to/from marina
  • Personal gear and sunscreen
  • Seasickness medication

6. LIABILITY AND ASSUMPTION OF RISK

6.1 Assumption of Risk

Fishing charters involve inherent risks including but not limited to:

  • Weather conditions and rough seas
  • Injury from fishing equipment
  • Slips, falls, and other accidents
  • Seasickness and sun exposure
  • Wildlife encounters

By participating, you acknowledge these risks and assume full responsibility.

6.2 Limitation of Liability

  • Mayan Reel Adventures’ liability is limited to the cost of the charter
  • We are not responsible for personal injury, property damage, or consequential losses
  • Guests participate at their own risk
  • We strongly recommend travel and medical insurance

6.3 Indemnification

Guests agree to indemnify and hold harmless Mayan Reel Adventures, its owners, employees, and agents from any claims, damages, or expenses arising from their participation in charter activities.

7. CONDUCT AND BEHAVIOR

7.1 Acceptable Behavior

  • Respectful treatment of crew, other guests, and marine environment
  • Following all instructions from Captain and crew
  • Adherence to local fishing regulations and limits

7.2 Prohibited Behavior

  • Harassment, discrimination, or abusive language
  • Excessive alcohol consumption or illegal drug use
  • Interference with vessel operation
  • Damage to equipment or vessel

7.3 Trip Termination

The Captain reserves the right to terminate any trip for safety reasons or unacceptable behavior. No refund will be provided in such cases.

8. FISHING REGULATIONS AND LICENSES

8.1 Guest Responsibilities

  • Valid fishing license required (guest responsibility to obtain)
  • Compliance with all local, state, and federal fishing regulations
  • Adherence to bag limits, size restrictions, and seasonal closures

8.2 Company Responsibilities

  • Guidance on current regulations and best practices
  • Assistance with proper fish handling and identification
  • Reporting of any regulatory violations as required by law

9. PHOTOGRAPHY AND MEDIA

9.1 Photo/Video Policy

  • Company may take photos/videos during trips for promotional use
  • Guests consent to use of their likeness in marketing materials
  • Guests may request removal from promotional materials
  • Professional photography services available for additional fee

10. FORCE MAJEURE

Neither party shall be liable for delays or failures in performance due to circumstances beyond reasonable control, including but not limited to:

  • Natural disasters or severe weather
  • Government regulations or restrictions
  • Mechanical breakdowns
  • Acts of terrorism or civil unrest

11. MODIFICATIONS AND AMENDMENTS

11.1 Trip Modifications

  • Departure times may be adjusted due to weather or tidal conditions
  • Trip duration may vary due to fishing conditions or safety concerns
  • Alternative fishing locations may be used at Captain’s discretion

11.2 Terms Modifications

  • These terms may be updated periodically
  • Current terms apply to all bookings
  • Significant changes will be communicated to existing reservations

12. DISPUTE RESOLUTION

12.1 Governing Law

These terms are governed by the laws of [State/Province/Country where business operates].

12.2 Dispute Resolution Process

  • Good faith negotiation for 30 days
  • Binding arbitration if negotiation fails
  • Legal proceedings only after arbitration

13. MISCELLANEOUS PROVISIONS

These terms constitute the entire agreement between parties and supersede all prior agreements or understandings.

13.2 Severability

If any provision is deemed invalid, the remaining provisions shall remain in full force and effect.

Failure to enforce any provision does not constitute a waiver of that provision.

13.4 Assignment

Guests may not assign their booking without written consent. Company may assign this agreement.
